Opposition Leader Lee Jae-myung Cleared of Election Law Violations

Date:

On Wednesday, the Seoul High Court delivered a significant ruling in favor of Democratic Party leader Lee Jae-myung, finding him not guilty of violating election laws during the 2022 presidential campaign.

This ruling overturned the previous decision made by the Seoul Central District Court, which had sentenced Lee to one year in prison—suspended for two years—for making false statements. The original case centered around accusations that Lee had violated the Public Official Election Act with false claims during his campaign.

The Seoul High Court found no evidence that a statement Lee made during a December 2021 media interview, in which he denied knowing Kim Moon-ki, a former executive at the Seongnam Development Corporation, was false. The court ruled that this statement did not amount to a violation of the law.

Furthermore, the court examined another statement Lee made during a parliamentary audit as Gyeonggi governor in 2021. Lee had claimed that the land ministry, under the administration of former president Park Geun-hye, pressured him to provide preferential treatment to a third party during the rezoning of the Korea Food Research Institute site. The high court found that this statement did not constitute a lie either.

In its ruling, the court emphasized the lack of concrete evidence that Lee had intentionally made misleading statements. As a result, the Seoul High Court acquitted Lee of the charges, clearing him of any wrongdoing.

The ruling has brought a sense of relief to Lee and his supporters, as the decision allows him to continue leading the Democratic Party without the cloud of a criminal conviction.

This case has attracted significant attention, especially considering the political context surrounding Lee Jae-myung and his leadership in the Democratic Party. It also highlights the ongoing tensions and challenges within South Korea’s political landscape.
